Words with an initial capital letter have the meanings defined below, regardless of whether they appear in singular or plural.

These Terms govern the use of the Services and set out the rights and obligations of all users. Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms and our Privacy Policy. By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part, you may not access the Services.

You affirm that you are at least 18 years of age, or possess parental or guardian consent, and are fully able and competent to assume the obligations, make the representations, and comply with these Terms. Please read our Privacy Policy carefully before using our Services.

You agree to use our Services only for lawful purposes described in the "Restrictions on Use" section below. You agree not to take any action that might compromise the security of the Services, render them inaccessible to others, or cause damage to the Services or their Content. To access some Services, you may be asked to provide registration details or other information. It is a condition of your use that all information you provide is true, correct, and complete. If we believe the information you provide is not true, correct, or complete, we may refuse, suspend, or terminate your access at any time, without notice.

You may use the Services for your own personal, non-commercial purposes and to learn about the Company and our offerings. We generally welcome links to our main landing pages, provided they are presented truthfully and respectfully and do not imply that we sponsor or endorse you. You may not frame, mirror, or otherwise display the Services within another website or application without our prior written permission, and any reproduction, adaptation, or distribution of our content beyond basic linking requires our prior written authorization.

By placing a Booking or Order, you warrant that you are legally capable of entering into binding contracts.

Your information. When you make a Booking, you may be asked to supply information relevant to your Order, including your name, email, phone number, payment information, and billing address. You represent and warrant that (i) you have the legal right to use the payment method(s) used, and (ii) the information you supply is true, correct, and complete. By submitting such information, you grant us the right to provide it to payment processing third parties to facilitate completion of your Order.

Order cancellation by us. We reserve the right to refuse or cancel your Order at any time for reasons including availability, errors in description or pricing, errors in your Order, or suspected fraud or unauthorized/illegal transactions. If your Order is cancelled, we will notify you and issue any applicable refund.

Your cancellation rights. Any Booking can only be cancelled in accordance with these Terms and our [Refund and Cancellation Policy], which forms part of these Terms. Please review it to understand your right to cancel.

Availability, errors, and inaccuracies. Information provided through the Services—including descriptions, pricing, dates, venues, line-ups, and availability—may occasionally be inaccurate, incomplete, or delayed in being updated. We reserve the right to correct, change, or update any information at any time without prior notice, and to refuse or cancel any Order affected by such errors, even after submission.

Prices. The Company reserves the right to revise prices at any time prior to accepting an Order. Prices may be affected by factors beyond our control, in which case you will have the right to cancel your Order. All prices are inclusive of applicable taxes (including GST) unless stated otherwise.

Payment may be made through various methods, such as cards (Visa, MasterCard, American Express, RuPay), UPI, net banking, or online payment methods such as wallets and gateways. Payment cards are subject to validation and authorization by your issuer. If we do not receive the required authorization, we will not be liable for any delay in processing your Order.

Instalment plans. Where the Company offers an instalment plan directly, and an error occurs collecting any instalment, access to the purchased Service may be suspended until the instalment is collected, and the Company reserves the right to charge any accrued instalments. If you use a third-party financing provider, that arrangement is solely between you and the provider, governed exclusively by their terms; the Company is not a party to and cannot modify, reverse, or waive obligations arising from such arrangements.

If you register for an Event, retreat, immersion, or programme, the following additional terms apply, and in the event of conflict with the general Terms, this section controls with respect to that Event.

Health and suitability. Our Events may include physical, emotional, and experiential activities. You are responsible for assessing your own suitability to participate and for disclosing any relevant health conditions or requirements. Participation is voluntary and at your own risk. Our Events are not a substitute for professional medical, psychological, or therapeutic care.

Programme content and changes. By purchasing access to an Event, you receive access to specific experiences, sessions, and materials. The Company may modify, reschedule, interrupt, substitute facilitators, or cancel any part of an Event at its discretion, for reasons including facilitator availability, venue or technical issues, programme improvements, or unforeseen circumstances. Where material changes are made, we will provide notice and seek to maintain the overall objectives and value of the Event. Minor adjustments do not affect refund eligibility.

Licence to use materials. Any materials provided in connection with an Event are licensed to you on a personal, non-transferable, non-exclusive basis for your own development only. You may not share, copy, distribute, reproduce, modify, or create derivative works from them, or use them for any commercial purpose. All rights in such materials remain with the Company and/or its facilitators.

Participant conduct and sharing. During an Event you may have the opportunity to participate in group sessions and discussions. Any decision to share personal information, ideas, or experiences with other participants is voluntary and at your own discretion. The Company does not control or monitor participant interactions and is not responsible for how other participants use, disclose, or act upon information you choose to share. Participants are expected to treat all shared information with respect, empathy, and confidentiality. Conduct that is disruptive, harassing, or unsafe may result in removal from the Event without refund, except where required by applicable law.

Recording and use of likeness. Events may be recorded in audio or visual form. By participating, you grant the Company the right to use such recordings for educational, informational, or promotional purposes in accordance with these Terms. If you do not wish to appear in promotional material, please notify us in writing in advance.

Refunds. Except where required by applicable law, Event fees are governed by the [Refund and Cancellation Policy] stated at the time of purchase. Where a specific Event includes a satisfaction guarantee or refund window, its terms will be stated at checkout or in the applicable offer.

Force majeure. Neither party shall be liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, pandemics or public health emergencies, war, terrorism or civil unrest, government orders or restrictions, widespread internet or telecommunications outages, or facilitator illness or emergency. In such an event, the Company may, at its discretion, reschedule, offer alternative delivery, refrain from charging for the cancelled portion, provide a pro-rata refund or credit, or extend access.

Depending on your place of residence, you may have statutory cancellation or refund rights that cannot be waived, including under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. Nothing in these Terms affects any non-waivable legal rights you may have under applicable consumer protection laws.

Any Promotions made available through our Services may be governed by separate rules. If those rules conflict with these Terms, the Promotion rules apply. Please review the applicable rules and our Privacy Policy before participating.

If you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities under your account, and you agree not to disclose your password to any third party. You must notify us immediately of any breach of security or unauthorized use of your account. The Company may investigate suspected violations of these Terms and cooperate with law enforcement authorities. You may not use a username that belongs to another person or entity, infringes another's rights, or is offensive, vulgar, or obscene.

The Services may include features powered by artificial intelligence or machine learning, such as automated tools that provide general informational responses or content suggestions. These features are automated systems and are not humans, medical, mental-health, financial, or legal professionals. AI-generated information may be incomplete, outdated, or incorrect, and you should independently verify it before acting on it. AI-powered features are not intended for crisis or emergency situations; if you require immediate assistance, contact local emergency services or a qualified professional. The Company disclaims liability for any reliance on AI-generated information.

Our Services and their original content, features, and functionality are and will remain the exclusive property of the Company and its licensors, and are protected by copyright, trademark, and other laws of India and other countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. Content may not be copied, distributed, republished, uploaded, posted, or transmitted without our prior written consent, except that you may print a copy of Content solely for your personal, non-commercial use. You may not manipulate or alter any images or other Content.

We respect the intellectual property rights of others. It is our policy to respond to claims that Content available through our Services infringes the copyright or other rights of any person, in accordance with the Copyright Act, 1957 and the Information Technology Act, 2000 and its rules. If you believe your copyrighted work has been used in a way that constitutes infringement, please submit a written notice to tribe@beyondxp.in including: identification of the copyrighted work; identification of the allegedly infringing material and its location; your contact details; a statement that you have a good-faith belief that the use is not authorized; and a statement that the information in your notice is accurate and that you are authorized to act on the copyright owner's behalf. Upon receipt, the Company may take whatever action it deems appropriate, including removal of the challenged Content.

The Services may contain links to third-party websites or services. Their inclusion does not mean we control, endorse, or take responsibility for them. If you access a third-party service, you are leaving the Company's Services, and your use of that service will be governed by its own terms and privacy policies. The Company is not responsible or liable for any damage or loss caused by your use of, or reliance on, any third-party service.

You grant the Company a royalty-free, perpetual, irrevocable, worldwide, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display any remarks, suggestions, ideas, graphics, or other information you communicate to us through the Services ("Submissions"), and to incorporate them into other works in any media. The Company is not required to treat Submissions as confidential. By making a Submission, you warrant that you have the legal right to do so and that it will not violate any law or any person's rights. We will treat any personal information you submit in accordance with our Privacy Policy.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

HEALTH AND WELLNESS CONTENT. Our Services offer health, wellness, fitness, and personal-development information for educational purposes only. You should not rely on this information as a substitute for professional medical advice, diagnosis, or treatment. To the fullest extent permitted by law, the collective liability of the Company and its affiliates, licensors, service providers, employees, agents, officers, and directors for any incidental, direct, indirect, punitive, consequential, special, or other damages—including loss of revenue, emotional distress, or similar damages—shall not exceed the greater of INR 10,000 or the total fees you have paid to the Company in the 12 months before the claim, for the applicable Content, product, or Service. Your exclusive remedy shall be limited accordingly. Some jurisdictions do not allow such limitations, in which case liability will be limited to the greatest extent permitted by law.

You will indemnify and hold harmless the Company and its affiliates, licensors, service providers, employees, agents, officers, directors, and contractors from any breach of these Terms by you, and from any claims brought by third parties arising out of or related to your use of the Services or any Content, including all losses, damages, costs, expenses, and legal fees.

You may not post, send, submit, publish, or transmit any content that: you do not have the right to post; advocates illegal activity or incites violence; is vulgar, obscene, or indecent; threatens, abuses, defames, or harasses others; is racist or offensive; exploits or harms children; infringes any intellectual property or other right; violates any law; impersonates any person or entity; advertises a commercial endeavour except as authorized; contains viruses or harmful code; disrupts the normal flow of the Services; amounts to a pyramid or similar scheme; or links to other sites containing such content. This list is not exhaustive and may be updated without notice. Although not obligated to, the Company reserves the right to monitor and remove content, and you remain solely responsible for your Submissions.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. Subject to applicable consumer protection laws, the courts at Chandigarh, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Services.
